This website is operated by Zentein Nutrition Inc. Throughout the site, the terms “Zentein,” “we,” “us,” and “our” refer to Zentein Nutrition Inc.

Zentein offers this website, including all information, tools, products, and services available through this site, conditioned upon your acceptance of these Terms of Service and the policies referenced in them.

By visiting our website, purchasing a product, creating an account, subscribing to a service, or otherwise using our website or services, you agree to these Terms of Service.

Please read these Terms carefully.

If you do not agree with these Terms, you should not use the website or purchase products through it.

These Terms apply to all users of the site, including browsers, customers, subscribers, vendors, and other visitors.

Any new features, products, or services added to the website will also be subject to these Terms unless expressly stated otherwise.

Nothing in these Terms limits or excludes any consumer right or remedy that cannot legally be limited, excluded, or waived under applicable law.

1. Online Store Terms

By agreeing to these Terms, you represent that you have reached the age of majority in your province, state, or jurisdiction of residence, or that you have the consent of a parent or legal guardian where legally required.

You may not use our products, website, or services for unlawful or unauthorized purposes.

You must not transmit viruses, malicious code, or other material intended to damage, interfere with, or compromise the website, our systems, or other users.

A breach of these Terms may result in suspension or termination of access to our services where appropriate.

2. Products and Product Information

We make reasonable efforts to present product descriptions, ingredients, nutritional information, photographs, prices, sizes, flavours, and other product information accurately.

However, packaging, product appearance, formulations, ingredients, supplier specifications, or other characteristics may occasionally change.

Always review the physical product label, ingredient statement, Nutrition Facts table, allergen information, directions, warnings, and other information included with the product before consumption or use.

If information displayed on the website differs materially from the physical product you receive, please contact Zentein Support before using the product if the difference may affect suitability or safety.

We reserve the right to correct errors, inaccuracies, or omissions in product information where appropriate.

3. Food, Nutrition and Health Information

Zentein sells food and nutrition products.

Information provided through our website, product descriptions, articles, customer support, educational content, or other communications is provided for general informational purposes unless expressly stated otherwise.

It is not intended to diagnose, treat, cure, or prevent disease and is not a substitute for individualized medical or professional advice.

Customers are responsible for determining whether a product is appropriate for their individual needs.

Customers with allergies, dietary restrictions, medical conditions, medication use, pregnancy, breastfeeding, or other circumstances that may affect product suitability should review product information carefully and seek appropriate professional advice where needed.

If you believe a product may be unsafe or has caused an adverse reaction, stop consuming the affected product and contact an appropriate healthcare professional when warranted. Please also contact Zentein so the matter can be reviewed through our food-safety process.

Nothing in this section limits Zentein's obligations under applicable food-safety or consumer-protection law.

4. Allergens and Ingredient Information

Customers are responsible for reviewing current ingredient and allergen information before consuming a product.

Because food production environments, suppliers, ingredients, and production practices can change, the physical package received by the customer should be reviewed before consumption.

If you have a serious allergy and are unsure whether a product is appropriate for you, please contact Zentein before consuming the product.

Nothing in these Terms overrides allergen declarations, food-safety requirements, or other obligations imposed by applicable law.

5. Orders

Submitting an order through our website constitutes an offer to purchase the products included in that order.

Receipt of an order confirmation does not necessarily mean that we have accepted or fulfilled the order.

We reserve the right, where reasonably necessary, to refuse, cancel, or limit an order before fulfillment.

Examples may include:

product unavailability;
obvious pricing or listing errors;
payment authorization problems;
suspected fraud or unauthorized payment activity;
unusual ordering patterns;
misuse of promotions;
resale or commercial activity inconsistent with an offer's stated terms; or
circumstances where fulfillment would violate applicable law.

If we cancel a paid order that has not been fulfilled, we will issue an appropriate refund for the cancelled amount.

We may limit quantities purchased per person, household, account, payment method, or order where reasonably necessary and where permitted by law.

6. Prices

Prices shown on the website are subject to change without notice unless otherwise required by law or a specific promotion.

Prices are displayed in the currency indicated on the website or during checkout.

Applicable taxes, shipping charges, duties, and other charges will be displayed or calculated where applicable.

We reserve the right to correct obvious pricing errors.

If a material pricing error is discovered after an order is placed but before fulfillment, we may contact the customer for instructions or cancel and refund the affected order where permitted by applicable law.

7. Payment

Customers agree to provide current, complete, and accurate billing and payment information.

You represent that you are authorized to use the payment method submitted for an order.

Payments may be processed by Shopify Payments, Stripe, PayPal, credit card networks, financial institutions, or other third-party payment providers.

Use of those payment services may also be subject to the applicable provider's terms and policies.

We do not guarantee that every payment method will always be available.

8. Shipping and Delivery

Zentein is responsible for fulfilling orders in accordance with our Shipping Policy, Refund Policy, and applicable consumer law.

Delivery issues may be evaluated using relevant evidence including:

carrier tracking;
delivery scans;
delivery photographs;
signatures;
delivery-location information;
the shipping address provided with the order;
customer-provided information;
carrier investigation results; and
other relevant evidence.

A carrier's delivery status or photograph may be important evidence when reviewing a delivery issue, but it does not automatically eliminate rights or remedies that may exist under applicable law.

Where available evidence reasonably establishes that an order was correctly delivered, a refund or duplicate shipment will not automatically be issued solely because the parcel is subsequently reported missing.

Where delivery cannot reasonably be verified, or where available evidence indicates incorrect delivery or carrier loss, Zentein will handle the matter in accordance with our policies and applicable law.

Nothing in these Terms transfers or eliminates delivery responsibility in a manner prohibited by applicable consumer law.

9. Delivery Addresses

Customers are responsible for reviewing the shipping address provided during checkout.

Please contact us as soon as possible if an address correction is required.

We cannot guarantee that an address can be changed once an order has entered fulfillment.

Additional shipping charges may apply if an order must be reshipped because of an incorrect or incomplete customer-provided address, refusal of delivery, failure to collect the shipment, or another recipient-related issue, where permitted by applicable law.

10. Signature Required Service

Where available, Zentein may offer Signature Required delivery as an optional paid service.

Zentein may also require or purchase Signature Required service for selected orders at our discretion.

Choosing or declining Signature Required does not waive any consumer right or remedy provided by applicable law.

If Signature Required is not shown as an available option during checkout, customers should not assume that a paid signature service has been purchased for their order.

11. Returns, Refunds and Order Problems

Returns, refunds, damaged shipments, missing products, quality concerns, and delivered-but-not-received claims are governed by our Refund Policy:

Because Zentein sells food, nutrition products, supplements, and other ingestible products, products are generally final sale for change of mind, taste preference, personal preference, or customer ordering error.

This does not limit remedies available for legitimate:

damaged products;
defective products;
incorrect products;
missing items;
quality concerns;
food-safety concerns; or
other rights provided by applicable law.

12. Goodwill Accommodations

Zentein may occasionally provide a refund, replacement, store credit, shipping accommodation, or other remedy as a goodwill gesture even when it is not otherwise required.

A goodwill accommodation is discretionary and does not establish an entitlement to the same accommodation for another order or circumstance.

Nothing in this section limits remedies required by applicable law.

13. Promotions and Discount Codes

Zentein may offer promotions, discount codes, volume savings, gifts, bundles, loyalty benefits, referral offers, or other incentives.

Each promotion may be subject to additional terms displayed with that offer.

Unless otherwise stated:

promotional discounts cannot be combined or stacked;
one promotional discount may apply per eligible order;
taxes and shipping generally do not count toward minimum purchase thresholds;
gift cards may be excluded;
already-discounted products or bundles may be excluded;
free gifts have no cash value;
promotions may be subject to product or quantity availability;
promotions are generally not retroactive to completed purchases; and
misuse, manipulation, unauthorized duplication, or other abuse may result in loss of promotional eligibility where permitted by law.

Zentein may correct a promotional error or withdraw an offer that was published in error, subject to applicable law.

Ongoing volume or quantity-based programs may be described as Mix & Match Savings, Volume Savings, or similar terminology.

We do not intend to create misleading urgency, false scarcity, fictitious regular prices, or other deceptive promotional representations.

14. Subscriptions and Recurring Purchases

Where Zentein offers subscriptions or recurring purchases, the applicable frequency, price, discount, billing terms, and cancellation or modification options will be presented before the customer subscribes.

By enrolling in a recurring purchase program, you authorize the applicable recurring charges in accordance with the terms presented when you enroll.

Subscription prices, product availability, and other terms may change where permitted by law. Where required, appropriate notice will be provided.

Customers may manage or cancel subscriptions using the methods made available through their account, subscription portal, or Zentein Support, subject to any processing deadlines disclosed for an upcoming order.

Cancellation of a subscription does not necessarily cancel an order that has already entered processing or fulfillment.

Nothing in this section limits cancellation or renewal rights provided under applicable law.

15. Gift Cards and Credits

Gift cards, promotional credits, or store credits may be subject to additional terms presented when issued.

Gift cards and credits cannot be redeemed for cash except where required by law.

Promotional credits may have restrictions or expiry dates where legally permitted and clearly disclosed.

16. Resale and Commercial Use

Unless otherwise agreed with Zentein, products purchased through our consumer website are intended for personal or household use.

Businesses interested in wholesale, corporate wellness, gifting, resale, or other commercial programs should contact Zentein for applicable commercial terms.

We may limit or cancel orders reasonably believed to involve unauthorized resale, diversion, promotional abuse, or other commercial activity inconsistent with the terms of the offer, subject to applicable law.

17. Website Accuracy and Availability

We attempt to keep the website accurate and available, but we do not guarantee that every portion of the website will always be uninterrupted, error-free, or current.

We may correct errors, update information, perform maintenance, or modify website functionality.

We may also discontinue features or services where appropriate.

Any limitation in this section is subject to applicable consumer law.

18. Third-Party Services and Links

Our website may use or link to third-party services including:

payment processors;
shipping carriers;
analytics providers;
subscription platforms;
review platforms;
social networks;
marketing services; and
other technology providers.

Third-party websites and services are operated independently of Zentein.

We are not responsible for third-party content or practices outside our reasonable control, subject to any responsibility that cannot legally be excluded.

Customers should review applicable third-party terms and privacy policies when using those services.

19. Reviews, Feedback and User Content

If you submit a product review, testimonial, suggestion, photograph, comment, feedback, or other content to Zentein, you represent that you have the right to provide that content.

You must not submit content that is:

unlawful;
defamatory;
knowingly false;
threatening;
infringing;
malicious;
deceptive;
obscene; or
intended to introduce harmful software.

Where you expressly submit content for publication, you grant Zentein a non-exclusive right to use, reproduce, display, format, and publish that content for purposes reasonably related to our business, subject to applicable privacy and other laws.

We do not purchase ownership of your personal information through this provision.

20. Intellectual Property

Unless otherwise stated, the website and its contents, including trademarks, logos, graphics, photographs, designs, product names, written content, and other materials, are owned by or licensed to Zentein and are protected by applicable intellectual-property laws.

You may use the website for lawful personal use.

You may not reproduce, distribute, modify, sell, commercially exploit, or create unauthorized derivative works from protected Zentein material without permission, except where permitted by law.

21. Privacy

Our collection, use, disclosure, and protection of personal information are governed by our Privacy Policy.

The current Privacy Policy is available through the Privacy Policy link displayed on Zentein.ca and through Shopify's policy pages.

If there is a conflict between these Terms and our Privacy Policy concerning the handling of personal information, the Privacy Policy and applicable privacy law will govern that issue.

22. Fraud, Misuse and Security

Customers must not misuse the website, payment systems, promotions, support processes, refund processes, or customer accounts.

Examples of prohibited activity may include:

unauthorized payment activity;
deliberately false claims;
manipulation of promotions;
attempts to obtain duplicate refunds or replacements through deception;
automated attacks on the website;
impersonation; or
other fraudulent or unlawful conduct.

Zentein may investigate suspicious activity and may apply reasonable account, payment, delivery, or promotional safeguards where permitted by law.

Nothing in this section authorizes Zentein to deny a legitimate statutory consumer claim merely because additional verification is requested.

23. Prohibited Uses

You may not use our website or services:

for unlawful purposes;

to infringe intellectual-property rights;
to harass or harm others;
to submit knowingly false or misleading information;

24. Disclaimer of Certain Warranties

every technical error will be corrected immediately;
every product will always remain available; or
website information will never contain an inadvertent error.

Products remain subject to all warranties, conditions, guarantees, and consumer rights that cannot legally be excluded.

Nothing in these Terms excludes statutory warranties, legal guarantees, or other mandatory consumer protections.

25. Limitation of Liability

To the fullest extent permitted by applicable law, Zentein will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of the website where such liability may lawfully be excluded.

This limitation does not apply where liability cannot legally be excluded or limited.

Nothing in these Terms excludes or limits liability for matters for which exclusion or limitation is prohibited by applicable law.

Nothing in these Terms limits statutory consumer remedies relating to defective products, food safety, misrepresentation, non-delivery, or other rights that cannot legally be waived.

26. Indemnification

To the extent permitted by law, you agree to indemnify Zentein against third-party claims, losses, or expenses arising directly from your unlawful misuse of the website, violation of another person's rights, or material breach of these Terms.

This provision does not require a consumer to indemnify Zentein for Zentein's own negligence, unlawful conduct, breach of statutory obligations, or other responsibility that cannot legally be transferred.

27. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally possible.

The remaining provisions will continue to apply to the extent permitted by law.

28. No Waiver

If Zentein does not immediately enforce a provision of these Terms, that does not necessarily waive our right to enforce it later.

Likewise, providing a customer with a discretionary accommodation does not waive these Terms for future transactions.

Mandatory rights provided by law are unaffected.

29. Entire Agreement

These Terms, together with our:

Shipping Policy;
Refund Policy;
Privacy Policy;
any subscription terms;
any promotion-specific terms; and
any other policies expressly incorporated into a transaction,

constitute the applicable agreement between Zentein and the customer regarding use of the website and purchases made through it.

If a promotion or other offer contains specific terms that conflict with these general Terms, the specific terms will govern that offer to the extent permitted by applicable law.

30. Governing Law

These Terms and transactions with Zentein are generally governed by the laws applicable in the Province of Ontario and the federal laws of Canada applicable there.

However, this provision does not deprive a consumer of mandatory protections or rights that apply under the laws of the consumer's province, state, territory, country, or other applicable jurisdiction.

Nothing in these Terms requires a consumer to waive a legal forum, remedy, or protection that cannot lawfully be waived.

31. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

our business;
website functionality;
products or services;
policies;
operational practices; or
applicable law.

The current version will be posted on this page with its updated date.

Material changes will apply prospectively where required by law.

Transactions already completed remain subject to any rights and obligations that applicable law prevents us from changing retroactively.
